A settlement agent manages all the paperwork, deadlines, and requirements involved in transferring property. In WA, only a licensed settlement agent (or lawyer) can complete this process. They act on your behalf to check contracts, liaise with banks, real estate agents, and government authorities, and make sure everything is finalised correctly. In short, they protect your interests and make sure the property is legally transferred into your name.
Yes. While real estate agents play an important role in marketing the property and negotiating the sale, they are not legally able to transfer ownership. Only a licensed settlement agent (or lawyer) can handle this process in WA. Your settlement agent manages the legal and financial side of the transaction, including preparing and lodging documents, liaising with banks, and making sure all conditions are met on time. By appointing your own settlement agent, you gain an independent professional who is focused solely on protecting your interests and ensuring the property is transferred into your name correctly.
It’s best to appoint a settlement agent as soon as your Offer and Acceptance contract is signed. This gives your settlement agent the opportunity to review the contract straight away, identify any issues, and make sure key deadlines are met. Early appointment also allows your agent to communicate with banks, brokers, and other parties from the start, which reduces the chance of delays or complications later. The sooner you bring a settlement agent on board, the smoother and more stress-free your property transaction will be.
Yes. As part of WA’s verification of identity requirements, all buyers and sellers must be formally identified during a property transaction. This ensures we are dealing with the correct person and protects against fraud. Identification usually involves providing documents such as your driver’s licence, passport, or birth certificate. We’ll guide you through exactly what’s needed and make the process simple, so your transaction complies with the legal requirements.
